(Memphis 8/5/2009) The old saying in sports goes something like this, a tie game is like kissing your sister. Sure, it's pretty disgusting, but that's what the folks in the sports world claim when both sides declare victory.

In Memphis, when both sides declare victory, it's called a victory for the people. Especially in the case of City Attorney Elbert Jefferson. Mayor Pro-Tem Myron Lowery isn't a real big fan of Elbert. He'd like him to hit the road, as a matter of fact. "I think he allowed to many attorneys to stay on retainer at taxpayer expense," Lowery said.

The trouble is, according to a Judge Walter Evans, Mayor Lowery acted a bit too soon. He needed approval by the Memphis City Council to replace Jefferson. So unless council members vote to remove Jefferson and hire a replacement...he stays.

Myron Lowery can suspend Jefferson or change his duties. But after the court hearing, Lowery said he wasn't sure what his future plans are.
