FAST FACTS:
(Memphis 10/30/2009) The office of Dr. Daniel Fearnow's office was raided this afternoon and he has been charged in a 12 count indictment charging him with illegally issuing prescriptions.
According to the indictment, Fearnow was a licensed medical doctor at the Wickman Family Medical Care center located on Hwy 64 in Memphis.
The indictment alleges that for ten months, Fearnow "...conspired to distribute Schedule II, III, and IV controlled substances by issuing written prescriptions for drugs outside the normal course of practice and for no legitimate medical purpose. Allegedly, Fearnow illegally wrote prescriptions on several occasions for Oxycodone, Lortab, and Alprazolam (Xanax). Federal Regulations prohibit prescribing and dispensing of controlled substances when not in the normal course of treatment according to Title 21, Code of Federal Regulations, Section 1306.4. "
Fearnow is charged with six counts of illegally writing prescriptions for a Schedule II drug. Each of those counts carries a penalty of up to 20 years in prison. Fearnow is charged with two counts of illegally writing prescriptions for a Schedule III drug. Each of those counts carries a penalty of up to five years in prison. Additionally, Fearnow is charged with three counts of illegally writing prescriptions of Schedule IV drugs. Each of those counts carries a penalty of up to three years in prison. The Conspiracy charge carries a penalty of up to 20 years in prison.
This case resulted from a yearlong investigation by the Drug Enforcement Administration and the Shelby County Sheriff's Office. Assistant United States Attorney Greg Gilluly is handling the case for the government.
