(Memphis 2/01/2010 ) The Memphis City School Board voted Monday night not to make any cuts to its budget.

They're asking the Memphis City Council to fully fund the district.

The City Of Memphis agreed to fund the district this year. Now they're holding out to the tune of $50 million dollars.

The council wanted the district to cut $12 million dollars from its budget to help with the $ 50 million funding plan.

Board members say they're not planning on making any cuts. Instead they voted to give the city the money when the two bodies settle their legal battle over school funding.

The district has already won two court victories. Each time the courts have said the City of Memphis needs to fully fund the district.

"Had it said the Shelby County Government, we would have been dead in the water." explained board president Martavius Jones. "But it said local government."

The city is trying to appeal to the Tennessee State Supreme Court. The court already said "no" once before to a direct appeal.
