(Kennett, MO 11/19/2009) After years of protesting and three days of testimony, Heather Ellis has agreed to a plea deal in her case.

Ellis was charged with assaulting police officers, resisting arrest and disturbing the peace at a Southeast Missouri Walmart.

Around 6:30 Friday night, we learned Ellis agreed to plead guilty to disturbing the peace and resisting arrest. The assault against an officer charge was dropped.

Ellis will attend anger management courses and be on unsupervised probation for a year.

Prosecutors earlier said they had offered her several deals but she denied them all.

Earlier today, Ellis was the first defense witness called in her trial.

Ellis says she and her 15-year-old cousin went to Walmart to pick up boxed relaxer for her mother.

She says they went to cash register number 13 but the line was moving slowly so she decided to split lanes.

Ellis went to register 14 while her cousin stayed at 13. 13 was moving faster so she went back to that lane.

Ellis says the lady behind her cousin put items on the conveyor belt and that it was moving forward. She pushed the items back because she says she was first. She then tried to tell the cashier she was first but she was ignoredr. Ellis says the woman in-front of her shoved her twice.

Ellis said police were called, she paid for her items and started walking out with police escorts. She says Kennett Police Officer Albert Fisher started yelling at her, calling her names, telling her to go back to the ghetto. Ellis says she continued walking to the police car when she says Fisher and other officers grabbed her, throwing her against car, ripping her leather jacket.

Jurors were still delibarating and had asked to view security tapes from Walmart when the deal was made.
