( Memphis TN 3/1/2010) The man running the Memphis Animal Shelter when allegations of neglect and abuse surfaced was set to appear in court this morning.

But Ernest Alexander was a no-show. His attorney says it was a mix up.

"They were supposed to have set a bond which was set a week and half ago. And they extradited him and he posted the bond," said Alexander's attorney Herschel Rosenberg.

Alexander was indicted on six charges of animal cruelty. This was after the Memphis Animal Shelter was raided by Shelby County deputies back in October after reports of several dogs died from starvation.

Alexander had returned to his previous home of New Mexico after he was fired by mayor A.C. Wharton. After being charged he was extradited to Memphis in mid-February to face those charges.

Alexander didn't have much to say when he bonded out of the CJC over a week ago and avoided our cameras. Alexander's attorney told News Channel 3 today says that he and his client were surprised by the charges.

"How would you feel? Especially if there were prior negotiations with the state and they were supposed to be an opportunity for him to talk to them," said Rosenberg.

All three former shelter employees are now free on a $25,000 bond. And although Alexander was not in court today, his attorney says is ready to face the charges.

"He is not guilty, there will be a plea of not guilty entered," said Rosenberg.

He is set to be back in court at the end of this month.

Former Animal Shelter supervisor Tina Quattlebaum and veterinarian Angela Middleton were also indicted on six charges of animal cruelty. If convicted Quattlebaum and Middleton could face up to six years in prison.
